The EU Settlement Scheme (EUSS) is crucial for EU, EEA, and Swiss nationals living in the UK post-Brexit. However, absences from the UK can impact your status, potentially delaying your path to settled status or even leading to its loss. Understanding the Home Office’s rules on continuous residence is essential for protecting your rights.

How Absences Affect Pre-Settled and Settled Status

Pre-Settled Status: Maintaining Continuous Residence

To qualify for settled status, you must complete five years of continuous residence in the UK. This means:

  • Spending at least six months in the UK in any 12-month period.
  • A single absence of up to 12 months for an important reason (e.g., pregnancy, serious illness, work posting, study abroad) is allowed.
  • COVID-19-related absences exceeding 12 months may be accepted with proper evidence.

If an absence exceeds 12 months without sufficient justification, your continuous residence is broken, and you will need to restart the five-year qualifying period upon return.

  • Five consecutive years outside the UK (four years for Swiss nationals).
  • Short visits to the UK reset the five-year period.
