Understanding Probate: Our Fees, Process and How We Can Help

At Arona St James Solicitors, we specialise in non-contentious probate, ensuring that the probate process is handled efficiently, reducing stress and complexity for our clients. With decades of experience, our solicitors have managed estates of all sizes, offering tailored guidance to suit each case.

Why choose an experienced probate solicitor?

Handling probate can be time-consuming and stressful, especially when managing deadlines, legal filings and financial obligations. Our team ensures that all paperwork is correctly filed, preventing delays and unnecessary complications. Working with us helps you:

  • save time and reduce stress;
  • ensure compliance with legal requirements;
  • prevent costly errors that could delay estate distribution.

Our fees and disbursements

Fixed fee structure

We charge a fixed fee ranging from 1.25% to 1.5% of the estate’s value, depending on its complexity. Once we have reviewed specific details, we provide a precise and tailored fee estimate.

Disbursements (third-party costs)

Aside from legal fees, certain third-party costs (disbursements) apply. These typically include:

  • probate application fee — £273 + £1.50 per sealed copy;
  • bankruptcy search fee — £6 per search;
  • London Gazette and local newspaper notice — approximately £400 + 20% VAT, to protect against claims from unknown creditors;
  • surveyor’s fees for property valuation — typically £150 + VAT, but varies.

How long does probate take?

In a straightforward case, probate can take six to twelve months from instruction to estate distribution. However, delays can occur if:

  • documents are missing, requiring additional searches;
  • the estate has complex assets requiring valuation;
  • beneficiaries or executors take time to respond.

Additional charges may apply in such situations.

Types of probate cases and fees

Straightforward probate cases

Estimated time: 8 to 15 hours. Legal fees: £2,250 to £5,000 + VAT.

Typical features:

  • a valid will;
  • no more than one property;
  • few bank accounts and beneficiaries;
  • minimal or no shareholdings.

Complex probate cases

Estimated time: 20 to 30 hours. Legal fees: £6,000 to £20,000 + VAT.

Typical features:

  • multiple properties or real estate in different jurisdictions;
  • business ownership interests;
  • high-value collectibles or memorabilia;
  • trusts with complications;
  • Inheritance Tax liabilities;
  • contested wills or disputes.

High-value estates (£2m+)

For estates exceeding £2 million, we charge a percentage-based fee of 1.2% to 2% of the estate value + VAT.

Note: for percentage-based cases, we do not add hourly fees; only third-party costs apply.
